1. Agreement and scope
These Terms and Conditions ("Terms") are a binding agreement between you and King Technology Group LLC ("KingTech," "we," "us," or "our"). They apply when you access or use a website, mobile application, or related digital service that links to these Terms, including the King Spa Virginia mobile application (collectively, the "Services").
By creating an account, accessing, or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.
These Terms supplement any terms required by the platform from which you obtained the app, including the Apple Standard End User License Agreement or applicable Google Play terms. Platform terms control only to the extent required by that platform.
2. Eligibility and accounts
The Services are not directed to children under 13. If you have not reached the age of majority where you live, you may use the Services only with permission and supervision from a parent or legal guardian.
You must provide accurate account information, keep your credentials confidential, and notify us if you believe your account has been accessed without authorization. You are responsible for activity performed through your account unless prohibited by law.
Age, identification, supervision, and admission requirements for a physical King Spa facility are governed by that facility's rules. Digital account access does not guarantee physical admission.
3. Limited license and service availability
Subject to these Terms, KingTech grants you a limited, personal, non-exclusive, non-transferable, and revocable license to use the Services for lawful, non-commercial purposes. You may not copy, sell, sublicense, reverse engineer, interfere with, or commercially exploit the Services except where applicable law expressly permits it.
Features may depend on your device, internet access, account status, location, app version, or facility operations. We may add, modify, suspend, or discontinue a feature when reasonably necessary for operations, security, legal compliance, or product improvement.
4. Coins, missions, and virtual items
The Services may provide promotional Coins, Gems, points, mission rewards, or similar virtual items (collectively, "Virtual Items"). Virtual Items are limited licenses to access eligible app features. They are not money, stored value, securities, cryptocurrency, or personal property.
- Virtual Items cannot be purchased for cash unless a future feature expressly states otherwise and complies with applicable platform rules.
- Virtual Items cannot be withdrawn, transferred, sold, exchanged for cash, or used outside the Services.
- Mission eligibility, reward amounts, daily limits, repeat periods, expiration dates, and available activities may change and are controlled by the terms displayed in the app.
- Virtual Items may expire or be adjusted when required to correct an error, reverse fraud, enforce these Terms, or comply with law.
Displaying a balance does not create a cash obligation. Our service records control if there is a discrepancy involving a Virtual Item balance or reward history.
5. Point Shop, coupons, and QR verification
Eligible Virtual Items may be redeemed in the Point Shop for available promotional coupons. A Point Shop redemption is not a cash purchase. Coupon inventory, eligibility, restrictions, validity periods, blackout dates, and availability may vary.
- Coupons are personal, non-transferable, and have no cash value unless expressly stated otherwise.
- A coupon may be used only once and cannot be used after its expiration date.
- Weekday, holiday, blackout period, capacity, facility, and other restrictions displayed with a coupon apply.
- Used, expired, altered, duplicated, or fraudulently obtained coupons may be rejected or voided.
Do not share a coupon QR code or barcode. A coupon is used only after successful verification by an authorized staff system. The verification record maintained by the Services controls coupon status if the app display and server record differ.
Issuance of an app coupon does not guarantee entry when facility rules, safety requirements, capacity limits, identification requirements, or coupon restrictions are not satisfied.
6. Facility information and separate King Spa terms
The Services may display facility descriptions, floor maps, pricing, schedules, notices, safety information, and links relating to King Spa Virginia. This information is provided for convenience and may change without notice. Facility staff instructions and posted rules control during an in-person visit.
The Services do not provide medical diagnosis or treatment advice. Consult a qualified professional before using a sauna, pool, spa, or wellness service if you have a health condition or concern.
Physical admission, day passes, gift cards, treatments, food and beverage, refunds, chargebacks, and on-site conduct may be governed by separate terms issued by King Spa Virginia. Review the applicable King Spa Virginia Terms and Conditions before purchasing or using those products and services.
7. Games, events, and promotional activities
The Services may offer games, missions, or promotional events for entertainment and engagement. Unless expressly stated in official event rules, these activities do not involve wagering, cash prizes, or items exchangeable for cash.
Additional rules, eligibility periods, limits, and prize or reward terms displayed for an event form part of these Terms. We may disqualify participation affected by automation, abuse, manipulation, fraud, or a technical error.
8. Notifications and communications
With your permission, we may send service notices and push notifications about account activity, facilities, coupons, rewards, events, or product updates. You can manage push notifications in the app or your device settings. Disabling notifications does not prevent essential account or legal communications.
9. Third-party services and content
The Services may use or link to third-party platforms, authentication providers, websites, maps, payment pages, or other services. Third-party services are governed by their own terms and privacy practices. We are not responsible for a third party's service except to the extent required by applicable law.
10. Acceptable use
You may not:
- Use the Services for unlawful, fraudulent, abusive, or unauthorized purposes.
- Share, resell, duplicate, alter, or manipulate a coupon, ticket, QR code, barcode, reward, or account.
- Use bots, scripts, emulators, automation, or other methods to obtain rewards or participate unfairly.
- Probe, bypass, disrupt, overload, or compromise any security, access control, server, network, or verification process.
- Upload malicious code or infringe another person's privacy, intellectual property, or other rights.
11. Ownership and feedback
The Services, software, design, text, graphics, logos, and other materials are owned by KingTech or used with permission and are protected by applicable intellectual property laws. No ownership right is transferred to you.
If you submit feedback or suggestions, you grant us a worldwide, perpetual, irrevocable, royalty-free right to use them to operate and improve our products without compensation or attribution, unless prohibited by law.
12. Privacy
Our Privacy Policy explains how we collect, use, retain, and protect information and how you can request access, correction, or deletion. By using the Services, you acknowledge the practices described there.
13. Suspension and termination
You may stop using the Services at any time and may request account deletion as described in our Privacy Policy. We may restrict, suspend, or terminate access when reasonably necessary to protect users or the Services, investigate fraud or misuse, comply with law, or enforce these Terms.
Where appropriate, we may provide notice and an opportunity to resolve the issue. Provisions that by their nature should survive termination, including ownership, disclaimers, liability limits, and dispute terms, will remain in effect.
14. Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available." We disclaim implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will always be uninterrupted, error-free, secure, or current.
Nothing in these Terms excludes a warranty or consumer right that cannot lawfully be excluded.
15. Limitation of liability
To the maximum extent permitted by law, KingTech and its affiliates, officers, employees, agents, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, Virtual Items, or opportunities arising from the Services.
Our aggregate liability arising from the Services will not exceed the greater of the amount you paid directly to KingTech for the affected digital Service during the 12 months before the claim or 100 U.S. dollars. This limitation does not apply where prohibited by law.
16. Indemnification
To the extent permitted by law, you agree to defend, indemnify, and hold harmless KingTech and its affiliates, officers, employees, and agents from claims, losses, and reasonable expenses arising from your unlawful use of the Services, violation of these Terms, or infringement of another person's rights.
17. Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles. Unless applicable consumer law provides otherwise, disputes relating to these Terms or the Services will be brought in the state or federal courts with jurisdiction in Virginia.
18. Changes to these Terms
We may update these Terms when our Services, business practices, or legal obligations change. We will post the updated Terms and revise the "Last updated" date. If a change is material, we may provide additional notice. Continued use after the effective date of updated Terms constitutes acceptance where permitted by law.
